While there are laws that specifically mention – and require – accessible digital content, some legislation is dependent upon the Court's interpretation. For example, the Americans with Disabilities Act (ADA) does not specifically mention digital compliance, but Title III of the ADA does require that a "place of public accommodation" is accessible. Today, Courts are interpreting a place of public accommodation to include the Internet and are therefore ruling in favour of digital accessibility.

The answer varies by industry. Many organisations are required by law to make their digital content accessible. For others, Courts are overwhelmingly ruling in favour of accessibility. So, while the rule of law can be confusing, there's no question an accessible site reduces legal risk and opens a business to a larger customer base.
